Presidential Regulation No.88 2017: Encouraging Prosperous Societies Sustainable

Ministry of Environment and Forestry (KLHK), Wednesday, June 6, 2018 Agrarian Reform, which is one of the programs in Nawacita which is accelerated its implementation of Land Tenure Completion in Forest Areas (PPTKH).

The President has issued Presidential Regulation No. 88 of 2017 on PPTKH, to accelerate agrarian reform through legalization of agrarian objects in forest areas. The Presidential Regulation is reaffirmed that the Government shall immediately resolve and provide legal protection for the rights of the people who control and utilize the land in the forest area.

The reason that the people who control the land in the forest area will be given the right of ownership, if they meet the criteria with the first three things the Land has been well utilized, and secondly, the land is not the object of the lawsuit / dispute, and thirdly, the recognition by the custom or the village head with reliable witnesses.

"PPTKH is one of the efforts to realize the first pillar of land ownership in terms of economic equity policy which was launched in April 2017," said Darmin Nasution, Coordinating Minister for Economic Affairs in Rakernas, on PPTKH at Hotel Bidakara, Jakarta (5/6 / 2018) as released Join News Network (JNN) Wednesday (6/6/2018) from the Ministry of Environment and Forestry (KLHK).

According to Coordinating Minister, Darmin Nasution, further said, economic equity policy there are three major pillars namely 1. Land Ownership 2. Provision of employment and effort opportunities, 3 human resource capacity improvement.

Forest area covering 63% in Indonesia is an object of agrarian reform targeted by the government. Land tenure within the forest area has experienced high inequality between private sector control and community control.

Only 4.14% of forest area owned by community management access, the rest is controlled by private sector. "Agrarian reform and social forestry imbalances will be improved.

"Up to the end of 2017 the release of forest areas for communities through the Land Reform Object Land (TORA) program increased from 12% to 38-41%, while the granting of social forestry access to the community increased from only 2% to 28 - 31% .

The agrarian reforms of forest areas and social forestry programs encourage prosperous communities to be sustainable, without conflict, environmentally friendly and have economic independence, "added LHK Minister Siti Nurbaya.

Siti added that the agrarian reform program and social forestry must be accompanied by continuous assistance from the government, based on six strategies, 1. Strengthening the village community empowerment program (forest), 2. Development with cluster system, 3. Community institution building and strengthening , 4. Increasing the capacity of community business management, 5. Land bussines technology and production processing, and 6. Building connections between farmers, SMEs and industries for economic growth.

Medium Term Development Plan (RPJM) 2015-2019, the granting of community access to forest resources is carried out by two mechanisms, namely the issuance of rights / rights of social forestry and the issuance of TORA rights proof. The difference is that with forest forestry social permit is accessible but forest function is maintained, whereas with TORA forest land is released its function becomes non forest and can be given the right of ownership. To that end, the Ministry of LHK has established an indicative area of TORA covering an area of ± 4,853,549 ha through the stipulation of the Minister of LHK No.180 / MENLHK / SETJEN / KUM.1 / 4/2017.

For social forestry through the issuance of PIAPS (Indicative Map of Social Forestry Area), there has been defined a social forestry indicative area of ± 13,462,101 ha through the determination of Minister of LHK No.22 / MENLHK / SETJEN / PLA.0 / 1/2017. Social forestry schemes can take the form of village forests, community forests, community plantations, forestry partnerships, and customary forests.

Minister of ATR BPN, Sofyan Djalil stated that, "PPTKH is very important because if the Minister of LHK has set clear limits on forest area, then the task of the Ministry of ATR BPN to issue land certificate will be easier And also the release of forest areas becomes very important as it concerns the people who live in the forest who will lose their rights to the facilities of the state such as subsidies and others ".

Meanwhile, the Chief of Staff of the President, General (Ret.) Moeldoko appreciated the provision of PPTKH. "More than 25,000 villages in Indonesia are located within the forest area, but it is difficult to obtain state facilities because of their legal status as forest areas, PPTKH should be a super scheme to resolve land conflicts in Indonesia," he said.

Also attending the event was Deputy Secretary of the Cabinet, Ratih Nurdiati, Director General of Area Administration of Interior Ministry, Eko Subowo. On that occasion, Minister Siti also gave an opportunity to the Governor / Vice Governor or representing from 26 Provinces to convey the problem and plan the steps of acceleration of PPTKH implementation in their respective region (BKnews/JNN).
